My business model needs to move to providing recommendations for advisors (along with all of the other shit I do).  Then I can sell my book to one of you jackasses and you can deal with FINRA/SEC/various states.

Mo - Can you create an entity (hedge fund/private equity/venture capital) where all your investors are shareholders based on the % of assets contributed to the total pool then invest it in one or more LLCs (based on strategy) that invest in whatever you want? You don't provide them any advice thus you would have no regulations? But of course this increases the chances of fraud on your part as seen thru the eyes of your shareholders. I would think by using a big name custodian would mitigate it though.

You are describing a Fund of Funds - which doesn't totally remove the reg requirement for iMo.

So lets say I own a company called Debolt Management and I purchase real estate, a couple small local companies, maybe a franchise or two. Put some money in the market, non-traded REITS etc etc...
 
What would you call that and at what point would regulations become a part of it?

He will have institutional clients then (specifically pooled investment vehicles) which can be a bigger pain in the ass to deal with.  At least you can soft dollar them though.

Say Debolt Management has 25mm market cap and 10mm is in an account at interactive brokers while the rest is invested in hard assets as mentioned above? Is 25mm too low to matter to anyone? What 50mm with 20mm in a brokerage account? Or 100mm with 40mm in IB?

I get annoyed by all rules and I am usually not aware of them until I get caught breaking them. Then I bitch about how stupid the rule is.

It pains me, literally hurts me to have to study up on a new VA that is on our platform because I just don't give a fuck.
